Permanent Visa
Under the quota _base_d section, permanent visas (green cards) are available in three main categories:
• Employment _base_d (EB-1 to EB-5)
• Family _base_d: quota free (immediately); and quota _base_d (FB-1 to FB-4)
• Diversification program _base_d (green card lottery)
Employment _base_d Green Cards
In most cases of employment _base_d green card applications, a labor certification is required from the Department of Labor (DOL). During this lengthy process, employers must prove that they are unable to find another qualified US-applicant or green card holder, willing and able to perform the job offered to the foreigner.
Stringent and continually changing restrictions apply to this visa and it is highly recommended to employ a certified immigration attorney to assist with the application.
Family _base_d Green Cards
Only spouses, parents and unmarried children under the age of 21 of US-citizens are en_title_d for permanent residence without any waiting period. Children above the age of 21 or married children must wait a number of years for processing.
Brothers and sisters of US-citizens have even longer waiting periods (more than 12 years currently).
Green Card holders are only en_title_d to sponsor their spouses and unmarried children to live in the USA.
Under no circumstances grandparents, grandchildren, uncles, aunts, nieces and nephews are en_title_d for family-_base_d visa petitions.
Diversity Visa Program
The easiest and fastest way to obtain a green card is still through the green card lottery. Because most other visas are very time consuming, we even recommend the lottery to relatives of US-citizens and green card holders who are still awaiting their family visa applications to become processed.
